Terms of Use
1. Acceptance of Terms
By downloading, installing, or using the Briefly application ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legal agreement between you and Modex Apps ("we," "us," or "our"), a company based in Albania.
2. License
Subject to your compliance with these Terms, Modex Apps grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial purposes.
You may not:
- Copy, modify, or distribute any content from the App without our prior written consent.
- Reverse-engineer, decompile, or disassemble any part of the App.
- Use the App for any commercial purpose or on behalf of any third party.
- Remove or obscure any proprietary notices or labels on the App.
- Use the App in any manner that could damage, disable, or impair our services.
All book summaries, content, and materials within the App are proprietary to Modex Apps or its licensors. All rights not expressly granted are reserved.
3. In-App Purchases
Briefly offers optional in-app purchases including a subscription and a one-time lifetime purchase to access the full book library.
- Subscriptions — Subscription purchases are charged to your Apple ID account at purchase confirmation.
- Auto-renewal — Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period.
- Renewal charges — Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price confirmed at purchase.
- Managing subscriptions — You can manage and cancel your subscriptions by going to your account settings in the App Store after purchase.
- Free trial — If a free trial is offered, any unused portion of a free trial will be forfeited when you purchase a subscription.
- All purchases are final — All in-app purchases are subject to Apple's App Store refund policy. We do not offer refunds outside of what Apple provides. To request a refund, visit reportaproblem.apple.com.
- Restoring purchases — If you previously purchased a lifetime licence or subscription, you can restore it at no charge via the "Restore Purchase" option within the App, or through App Store Settings.
- Lifetime purchase — A one-time lifetime purchase grants permanent access to the full library under these Terms. This is not a subscription and does not renew.
4. Prohibited Use
You agree not to use the App to:
- Violate any applicable law or regulation.
- Infringe the intellectual property rights of Modex Apps or any third party.
- Transmit any harmful, offensive, or unlawful content.
- Attempt to gain unauthorised access to any part of the App or its related systems.
- Use automated means (bots, scrapers) to access or extract content from the App.
5. Intellectual Property
The App, its original content (including all book summaries), features, and functionality are owned by Modex Apps and are protected by applicable intellectual property laws. Book titles and author names referenced in the App are the property of their respective owners and are used for descriptive purposes only.
6. Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the App will be error-free, uninterrupted, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any content within the App.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Modex Apps and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, even if we have been advised of the possibility of such damages.
Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid for the App in the twelve months preceding the claim.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of Albania, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Albania.
9. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the effective date above. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
10. Termination
We reserve the right to terminate or suspend your access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
